Recognition Partnership (Anerkennungspartnerschaft)

Anerkennungspartnerschaft

What employers need to know

The recognition partnership (§16d) is a new pathway introduced in 2024 that allows skilled workers to come to Germany and work while their professional qualification is being recognised. This removes the biggest bottleneck in skilled worker immigration — the months-long recognition process.

Typical timeline: 2-4 months to entry, then 6-18 months for recognition completion

The law, simplified

Section 16d AufenthG creates the recognition partnership — a groundbreaking pathway introduced in March 2024 as part of the Fachkräfteeinwanderungsgesetz reform. It allows non-EU nationals to enter Germany and start working immediately while their professional qualification recognition is still in progress. The employer and employee sign a recognition partnership agreement committing to complete the recognition process within a set timeframe. The employee can work in a related field during the process. If full recognition is achieved, the permit converts to a regular skilled worker permit (§18a or §18b). This pathway is especially valuable for vocational professions where the recognition process previously took 6-12 months before the worker could even apply for a visa.

Your obligations as employer

  • 1Sign a recognition partnership agreement (Anerkennungspartnerschaftsvereinbarung) with the employee
  • 2Commit to supporting the employee through the recognition process (time off for courses, exams, etc.)
  • 3Employ the worker in a position related to their qualification during the recognition process
  • 4Pay a salary appropriate to the qualification level being recognised
  • 5Cooperate with the recognition authority and meet agreed timelines

  • State-recognised professional qualification from their home country
  • At least 2 years of relevant professional experience

Common pitfalls

Recognition failure: If the candidate fails to achieve recognition within the agreed timeframe, they may need to leave Germany — set realistic timelines
Language barrier: Even at A2, the candidate may struggle with recognition exams in German — build in language support
Employer commitment: The employer must genuinely support the process — companies that treat it as a way to get cheap labour risk the permit being revoked
Regulated professions: For nursing, medicine, and engineering, additional state-level approvals may be needed alongside the recognition
