What employers need to know

The law, simplified
Section 16d AufenthG creates the recognition partnership — a groundbreaking pathway introduced in March 2024 as part of the Fachkräfteeinwanderungsgesetz reform. It allows non-EU nationals to enter Germany and start working immediately while their professional qualification recognition is still in progress. The employer and employee sign a recognition partnership agreement committing to complete the recognition process within a set timeframe. The employee can work in a related field during the process. If full recognition is achieved, the permit converts to a regular skilled worker permit (§18a or §18b). This pathway is especially valuable for vocational professions where the recognition process previously took 6-12 months before the worker could even apply for a visa.
Your obligations as employer
